1. Acceptance of Terms

By using our website, submitting a quote request, scheduling a call, or working with Canyon Creek Benefits and Noe Recendez, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Who We Are

Canyon Creek Benefits is a licensed insurance agency owned and operated by Noe Recendez. We help individuals and families in the states where we are licensed evaluate and enroll in Medicare Advantage, Medicare Supplement, Part D prescription drug plans, life insurance, annuities, dental, vision, long-term care, and ACA health insurance plans.

3. No Insurance Advice; Educational Information Only

The content on our website is provided for educational and informational purposes. It is not legal, tax, financial, or medical advice. Any recommendations made in the context of a formal consultation will be based on the information you provide and the plans we are contracted to offer in your state. You should independently verify any plan details with the issuing insurance carrier or Medicare.gov before enrolling.

4. Use of the Website

You agree to use our website only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use of the site. You may not:

• Submit false, misleading, or fraudulent information.
• Attempt to gain unauthorized access to any part of the site, server, or connected systems.
• Use automated means (bots, scrapers) to access or collect data from the site.
• Transmit viruses, malware, or any harmful code.
• Use the site to impersonate any person or entity.

5. Communications and Consent

When you submit our contact form, check the consent box, or otherwise provide your contact information, you authorize Canyon Creek Benefits to contact you via phone, text message (SMS), and email regarding insurance products and services. This may include automated dialing, pre-recorded messages, and SMS, at the number and email you provide.

5.1 SMS Text Message Program

Program description. By opting in through our website form or by otherwise providing express written consent, you agree to receive SMS text messages from Canyon Creek Benefits at the mobile phone number you provide.

Types of messages you may receive include:

• Quote follow-up and plan information
• Appointment reminders and scheduling confirmations
• Policy and enrollment updates (e.g., application status, required documents)
• Customer service responses to your questions
• Annual enrollment period (AEP) reminders and plan review notifications

Message frequency. Message frequency varies based on your interaction with us. You should expect approximately 2–6 messages per month on average, with higher volume around appointment times and during the Medicare Annual Enrollment Period (October 15 – December 7).

Opt out & help. You can opt out at any time by replying STOP to any text message from us. After you send STOP, we will send you a confirmation message and will not send further SMS messages. For assistance, reply HELP or contact us at (385) 469-6438 or [email protected].

Costs. Message and data rates may apply depending on your mobile plan. Canyon Creek Benefits does not charge you for SMS messages; however, your wireless carrier's standard messaging and data rates will apply.

Carrier disclaimer. Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, and other major and minor carriers. Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your network operator and is not guaranteed.

Not a condition of purchase. Your consent to receive SMS messages is not a condition of purchasing any product or service.

Privacy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. See our Privacy Policy for full details.

5.2 Email and Phone

You may opt out of email communications using the unsubscribe link in any marketing email. To stop phone calls, simply inform us during a call or by emailing [email protected].

6. Pricing and Compensation

We do not charge you a fee for our services. Canyon Creek Benefits is compensated by the insurance carriers through standard commissions when a policy is issued. The premium you pay for any policy is set by the insurance carrier and does not increase as a result of working with us. You always have the option to enroll directly with the carrier or through Medicare.gov.

7. Intellectual Property

All content on canyoncreekbenefits.com — including text, graphics, logos, images, videos, and software — is the property of Canyon Creek Benefits or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

8. Third-Party Links and Carriers

Our website may include links to third-party websites, including insurance carriers, government resources, and service providers. We do not control and are not responsible for the content, policies, or practices of those third parties. Your use of any third-party site is at your own risk and subject to their terms.

9. Disclaimer of Warranties

The website and our content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Canyon Creek Benefits disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. 10. Limitation of Liability

To the fullest extent permitted by law, Canyon Creek Benefits, Noe Recendez, and our affiliates, agents, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the website or our services, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed one hundred dollars ($100).

You agree that any legal action arising under these Terms will be brought exclusively in the state or federal courts located in Utah County, Utah, unless otherwise required by applicable insurance or consumer protection laws.

Before filing any claim, you agree to first contact us in writing and attempt in good faith to resolve the dispute informally. If we cannot resolve it within 30 days, either party may pursue the claim in a court of competent jurisdiction in the State of Utah.
